The former governor of Abia State, Senator Orji Uzor Kalu has got a sigh of relief on Monday 8th February 2021, as the Federal High Court Abuja grant him the request to challenge the Federal Government’s plans to resume the trial of Orji Kanu and his company over the fraud case of N7.65 billion.
One should recall that the Supreme Court of Nigeria had on 8th May 2020, voided the conviction and sentencing of Senator Kalu and ordered for retrial.
It was in obedience to the apex court ruling that the Chief Judge of the Federal High Court reassigned the case to Justice Inyang Ekwo for retrial.
On 2nd February 2021 court sitting, while Economic and Financial Crimes Commission (EFCC) appealed to the court to grant their request to transfer the venue venues of retrial back to Lagos where the case was conducted earlier, Kalu Awa Kalu (SAN), Senator Kalu”s lawyer, according to Vanguard News “argued a motion ex-parte for permission to challenge the legitimacy of the retrial, claiming his client would be subjected to double jeopardy should he be tried again on the same charge.”
